If you have been arrested and the charges are finally dropped, how do you respond to job applications that ask, "Have you ever been arrested?"
Especially want to know for California.

I believe in California misdemeanors that are dropped don't have to be on an application. If not then you should put yes you have been arrested but write somewhere next to it that the charges where dropped, usually they have a spot for you to explain what happened on the application. The reason you want to do that is if they pull up your background it will show what you where arrested for and that the charges were dropped. I am a going through kinda the same thing right now i had to go get a background check and it cost me 5 dollars and i had two charges that were dropped but on the report it showed that i was arrested for it and then the charges were dropped. The only way to remove it is to get it expunged off of your record. |

If there is a background check and all of your charges were dismissed there shouldn't be a record but if they were not dismissed then there may be a record. Normally when a employer asks if you have ever been arrested they want to know if it was for a felony, drugs or DUI. charges dropped mean that they weren't able to prove that there was a crime committed so there shouldn't be a record. to be sure go to your sheriff's office and ask for a criminal background check this will cost you 10 - 15 bucks |

i would mark yes, cause if you lie they can fire you if you lie. or tell person who is taking app. that u was arrested but it was droped. |

I heard that you dont have to answer yes to arrest questions on job applications if your arrest record has been erased , or sealed or expunged , that you can answer no truthfully to that question. I had that issue myself in Texas, my background check is always good to go even though i was arrested back in 1994 and my case was dismissed thrown out of court. However if applying for state for federal jobs, i would list say yes. |
