As an employer, can i add monitoring software to just one employee rather to all?

I have one employee always on the phone or the internet and I would like to prove it that she is aways on the web for personal reasons. Because of expense, I dont want to add to everyones computer. Is this legal in NY?

Best to ask your lawyer. New York State is one of the states where the legislators actually work for their money, and thus they make a lot of laws. Since it's your computer at your establishment, you may have recourse, but you need to know what you can do in pretty detailed fashion.

Of course it is. It's your shop and your equipment. The only one entitled to any privacy is you. Being discriminate and discriminating are not the same. Just as you can allow access to your employees on an as needed basis, you can direct your security measures the same way.

Criminal search and seizure restrictions do not apply to civil employment situations, especially where a complete lack of ownership is so obvious. Carry on and good luck.

Nope, because if that person is a female, an older person or a minority, it may look like discrimination

That way, when you find something, you can prove that everyone was monitored equally, and that one employee violated company policy....that gives your case incredible weight.

Be fair about it...and don't assume that you know what all of your employees are doing what they are supposed to be doing.

Load it on everyone's computer...you may be suprised at what you find.
