Background check?

If someone runs a background check on you, like an employer, can they find out if you have been CHARGED but not CONVICTED of a crime?

Yes more and more applications now require you to state if you have been charged with a crime which there has not been a conviction yet. This is to let your potential employer know if there are any charges pending against you that might make you unable to work if a sentence is laid out.

Many employers will also look into these charges to see if they might go against the safety of their employees or the company in the future.

A background check will find your charges as they are usually recorded in the courts files within 48 hrs after you were arrested or received a ticket/summons.

If you were charged but the case was dropped then in most states you don't have to put that down on the application. But if the case is still pending, open or if you have yet been to an arraignment then if asked on the application you will have to state your charge.

IF the application does not state if you have been charged only if you have been convicted then you dont have to put your charge down !

YES! pending on the type that they do, all information can be pulled up. I do it everyday for people whom is trying to get out of jail. Even if the case is pending, it will show.

YES they can pull that record on you. They can also pull the record of arrest but can not disqualify you for it. They can only disqualify you for the position if you have been convicted and most only will do so if is a felony, dont get me wrong some will boot you for misdemeanors but that usually only occurs when you lied directly on your application. I am a manager at a background screening firm.

Nope. If someone tells them that your where charged for a crime that you where never convicted of that would basically fall under double jeoperdy ( I'm quite sure I mispelled that). That would be a lawsuit looking for a place to happen.
