Background checks?

If you are fired from your job, how much information can the employer doing the firing contribute to a background check?

And does the severity of the reason for being fired from a job determine whether or not it is put on your "official" background?

Depends on the state law and/or company policy.

Many employers, to avoid defamation claims, will only permit the release of employment dates and title, sometimes last pay rate and whether they are eligible for rehire.

Some state laws say that an employer or a person cannot maliciously prevent a person from seeking future employment and that doing so is a crime. However, if an employer discloses information that is truthful and so in a manner that is fair, such as responding to a request from a potential employer, then they have not done anything defamatory or malicious.

That information does not come out on a background check, the only information that is disclosed on a background check report is any type of criminal offense that you have been evolved or convicted of.

They would be considered part of your employment background check. If your employer that fired you was called by a potential employer he can't give details that you were fired or why. But he can make the statement that he woundn't hire you back. I don't know what determines whether or not it goes on your "official" employment background check.

Don't believe it when you are told that former employers can only give dates of employment, salary, etc. NOT TRUE. Not sure where that crazy information started, but it's not true.

There may be some companies that only give out that type of info, it might be their company policy, but there is no law stating it's all they can give.

What is legal is that a former employer CAN GIVE FACTUAL information. If you had poor attendance, if you were fired because they believed you stole (yes, they can share what they believe to be factual), if you were late often, they can provide that information.

your old employer can state date of hire, if they did a background check, and date of termination. You, being the honest person you are will of course inform your new employer the facts,ie" My former employer and I didnt see eye to eye on my job description", I dont think he or she will give me a flowery recommendation"
