I have been working in a company for a week now, and since day 1 I have been being disrespected and put down. The one manager has yelled at me in front of several customers, and calls me dumb, stupid and says racial remarks as well. The position is a clerical position in an air conditioning company(which I have NEVER done before).. I am still learning everything about how they run their office... I am just wondering if it is legal to put someone down like this on a regular basis..

the law does not protect you from bad behavior.
for discrimination to be proven there must be an adverse job action. harassment can be proven if it causes a "hostile work environment" but that is extremely difficult to prove.
this mangers behavior needs to be reported to his/her supervisor and the company needs to deal with it. keep documentation but the law is pretty clear and what you have here is pretty much a matter of poor management skills and not anything the law is going to resolve. |

The manager's behavior is certainly inappropriate and should be dealt with by his supervisor or the company's HR department. Nobody should be subjected to such behavior at work and it is counterproductive for the organization. This behavior lowers morale not only of the employee directly affected, but those around this person as well. If the organization does not act on the behavior, it is very likely other employees will lose respect for the management team.
Your question, however, deals with the legality of this issue. Unfortunately, I am unaware of any law that would make these comments illegal, except perhaps for the racial comments. If the racial comments are severe or pervasive, they could constitute racial harassment which is illegal in the United States under Title VII of the Civil Rights Act of 1964.
I would suggest you seek the counsel of your HR department. Retaliation for bringing a claim under Title VII is illegal. They should be able to help you sort this out.

That's harassment and racial remarks included give you a lawsuit. Record it, then go out on work related stress. Have a labor lawyer file a complaint with the NLRB(although Bush appointed corporate attorneys and x ceos), and most importantly file a Workman's compensation case.Take the rest of the summer off and stress. You have many laws protecting you when it comes to your job. Unfortunately most people aren't aware of them and are afraid of being fired for standing up to the boss. This guy didn't give you a chance, don't give him one, go right for the throat! |

You need to IMMEDIATELY document all incidents where you have been called racist names or where demeaning verbal remarks have been used by your supervisor or other employees. You must have the date of the incident, the time of the incident (even in general, like "in the afternoon"), a description of the incident (all words used, to the best of your recollection), and the names of all people who spoke or witnessed such (if you know them). This must all be written down, and you need to do this immediately. If this is a large company and there is a large human resources office, you need to go to this office immediately with your documentation of these incidents (and keep copies for yourself, and add the date of your HR visit, the name of whom you spoke with, etc.). Tell them you cannot continue to work this way. Give them a chance to resolve the situation -- they may not be aware of this manager's behavior.
Also, go to your state's Department of Labor web site and read up on what you do if you are being harassed or discriminated against on the job. Many states have an online form for you to fill out. But first, you MUST have the documentation I talked about earlier. |
