Whether you get anything to drink or not. When we all first started we signed a contract that stated she would take out $1.00 a shift now she has raised it to $2.00. So every week each employee is having $10 dollars taken from their paycheck. Is this legal? We sat down and figured out that at $2.00 a day she is making close to $100.00 a day just off of us showing up to work. I think its wrong you should have the option of saying yes or no. I have no problem not drinking at work (I can stop at 7-11 and buy a big gulp for cheaper than what she is charging us) I'm also a server and our pay is only $3.77 (plus tips we get of course) but $3.77 from her and each day she basically takes almost our first entire hour of pay from us.
So, anyone know if its legal for her to do this or not. A few people that work there have said it's not but I have no idea. Additional Details I did sign the paper for $1.00 there wasn't anything about her being able to increase the amount and we all signed this contract one month ago now she is raising amount.
To the person who said she isn't making money off us because we are drinking sodas. Yes she is. she has anywhere from 40 people working dayshift and 40 others that come in for night shift so that is close to 80 a day and we pay 80 whatever money she gets off customers buying sodas does become pure profit for her. As far as calling corporate there is no corporate this is an individually owned business. I haven't said anything because I do like working there and I was fine with $1.00 a day (even tho if I do drink its just water) but now that she has jacked it to $2.00 a day it feels as if she is nickel and diming her employees.

Whether or not it's legal in the first place, I don't know, but if you signed a contract for a $1.00 fee that she increased to $2.00 without your signoff, then that can't be legal. |

Unfortunately it is legal, and most restaurants do have some kind of policy to pay for your drinks. The Italian restaurant I worked at just charged us a dollar a drink no matter the original price. This may seem like a lot, but this restaurant didn't have a drink dispenser. ALL BOTTLES dumbest thing I have ever seen. But yes it is totally legal. You may be getting jipped because you don't have anything to drink but your colleagues may be abusing it. |

well you signed a contract authorizing it. Did that contract say she could raise the rate with inflation? She is not making 100 a day off of you folks, that money is being used to cover the drinks that the servers are drinking. It is what it is, my advice is that you start drinking at work and quit whining |

It is legal, but it MUST be a voluntary program.
If she is forcing you to agree to it...then you are free to get another job. |

If you signed a contract that said $1, then she takes one dollar. But if she just magically pops out of nowhere and takes more, that is probably illegal. Get a big, nasty lawyer and tell him/her. You'll get that money that she stole, plus a lil' extra. |

It became legal once you signed the contract. Before you signed it you should've read company policies and call corporate headquaters to see if all they businesses charge a beverage fee. If its not allowed then she will be in a lot of trouble. |

This is a bit touchy. On one hand you don't like this "rule" at work but on the other hand if you make a stink about it she could just let you go.
I do know some Companies that have an employee cafeteria that they deduct $ from your pay for the use of it but those situations the Company is covering a huge amount and the employee only a buck (breakfast, lunch, drinks the whole lot for only a buck).
In your situation you should be able to approach your boss and say since you don't participate in the drink thing that you would like to sign a waiver or something to opt out of this plan at work. This way you are not arguing the fact that you think the amount of money is a joke but that you just don't want to participate. |

But ask others how they feel. Then take legal advice or just talk to the boss. |

I'd say this was all kinds of illegal! Do you have a contract of employment with this written in to it?
Tell your boss/human resources manger that with immediate effect you wish to not be part of this scheme and if she says it is non optional, consult an employment attorney to ascertain your exact rights - but I am pretty sure this is not OK! |
