Breach of contract? Can she take me to court?

So let's say I "bought" a used car from my brother's fiance. She wrote a contract stating when payments were being made, the amoung and put "sold as is". We both signed the contract. Thing is that the car got impounded about 20 days after I got due to registration not being paid. Now, the whole registration thing was not in the contract, but we did agree verbaly that I was not to drive the car unless the ins and registration was good. Before she "sold" the car to me she told me it did not have ins nor registration. Now she wants to take me to small claims because I haven't made a car payment and the there are $1,600 in impound fees, I don't think I am responsible for these fees since the car is still in her name. I don't plan to pay for the car neither because I don't have it. Now, the only thing that I feel I should pay is $500 for the use of the car for two weeks. What do you guys think? Does she have a case against me because I don't think so. The car is under her name therefore everything is her responsibility including the impound of the car right?

But she didn't change the name on the title. She stipulated on the contract that the title would not be changed util the final car payment was made.

You have the words "bought" and "sold" in quotes, which leads me to believe this wasn't exactly a straight forward transaction. BUT...since you "signed" the contract...you "owe" the money.

EDIT: She was smart not to change the name on the title until you 'owned' the car, because as it turns out...you never technically 'bought' it. Bottom line...she has your signature on the contract...so it's a done deal...get ready to pay up.

Anyone can take anyone to court for anything. If you signed a contract knowing the terms, and did not abide by them, you may hold some financial responsibility. Having an attorney who has read your contract and can advice you would be the best advice at this point.
