Can A Company Do this?

My husband works at Comcast. A week before Thanksgiving 2008, he reported to his supervisor the days he wanted to take for vacation in Dec. The supervisor took the days down. My husband gave the supervisor a while to get things down but kept giving him gentle reminders that he was taking these two week of vacation in December. I am certain my husband reminded him over 6 times. He would ask the supervisor and the supervisor assured him that he had taken care of thing.
My husband is on his second week of vacation, yesterday we were expecting a large vacation check so that we could purchase some gifts for our children for Christmas. My husband check was without the vacation pay. We were both deeply sadden and in shock.
Comcast had always given vacation pay before the vacation began or in the midst of it.
That evening at 4:30 p.m., my husband received a text message from his supervisor telling him, "If you want to be paid for your time off you better submit it ASAP!."
The lady that does payroll has quit and no one in the office knows what to do.
We are hurting because we feel our children's Christmas is ruin. We also fear that maybe he has lost his window of time to take vacation being that vacation time should be submitted two weeks before you actually take it. The supervisor's email suggested that he was indanger of losing his this time.
We don't really want to cause any waves because this is his place of employment.
But what steps should we take? We know there is nothing that can be done now about Chritmas. This is the second time his supervisor has done this to him.
Any advise would help. What should we do?

The young lady that was doing payroll, last day was a month after my husband first submitted his vacation days.
Her last day was this Friday, which was the day that the supervisor emailed my husband with the alert to submit his own vacation, which my husband was not suppose to do.

First, accept that your probably not going to be okay for Christmas. Your holiday is not ruined, you don't need to spend a fortune to show your children you love them.

There are a variety of things you can do that cost little
- movie marathons
- go out to the local attractions
- build snowmen ? (if you have snow)

Work has rules and you should go to the supervisor's boss and look up is there is a person responsible for dispute resolution in Comcast. If the supervisor is doing this to your husband, he may be doing it to others as well. This supervisor is bad for morale and your husband should point out that the negative effects not on your family but on the business which result from being messed around like this. Business people understand the concept of morale, that's why they give bonuses in the first place. The supervisor obviously needs to be disciplined in such a way as makes it clear this will not be allowed to happen.

If the company cannot resolve the situation, and this may take a while jumping through hoops, then you should try a union rep or lawyer. It sounds like your husband did everything he could and is being messed around. You have a legitimate complaint.

However, be realistic, with a week to go most people are worried about their Christmas, not yours.

I would go to human resources since his boss has done this before. Have your husband give every detail. Like the date he submitted the request of the vacation. Also the methods and number of times he reminded his boss. I would also check if there is a higher up he can give his vacation requests to from now on. Good luck!

Comcast is a huge corporation. Never forget. Your husband needs to contact the Human Resource at Comcast Headquarter. By law, if your supervisor screws you, you are entitled to go over the head of the supervisor.

Your husband supervisor is at fault here. If your husband wants to keep his job with Comcast, he better contact higher managers at Comcast. Comcast is liable legally for jurking your husband around.

Comcast is a machine, not necessarily run by fair supervisors. If the supervisor has the audacity to do what he did to your husband, beware.

By law, you are required to denonce unfair practice at work.
Because the employer is liable.

I have hired and fired many in my life. I understand how it feels to be an employer.

Christmas is no longer about gifts, Christmas is about love, patience, perseverance, unity of family regardless of money.
Christmas is about hugging and laughing, not because of how many gifts you gave out or received, Christmas is about respecting tragedies of parents.

Explain to your children what happened. They have a right to know that as adults, we are faced with tragedies and as adults we survive the challenges in our lives.

My tragedy this Christmas of 2008 is that I do not have enough heat in my house to keep me warm. We are in the middle of a snow storm and I am wearing my mother's fur coat. My mom died last May and among the few objects I inheritated from her is the beaver fur coat.

Thank god, I am now warm typing and writing you my answer.

In order for your children to grow up as responsible adults, they must face the same challenges as the parents. You are afraid your Christmas is ruin because you are a vicitm to your husband supervisor.

Your husband supervisor could put Comcast in deep trouble if I was your husband's attorney. The law is on your side. Hold your husband's hand when he calls the Human Resource Department of the Headquarters of Comcast. Monday Morning, first thing, have him call.

You cannot predict your future with your fear. Comcast will pay your husband, regardless of the deadline of Christmas.

Keep the Christmas tree in your house until you get paid. Tell your kids that when you do get paid for the vacation time, you will have a party. Maybe Christmas of 2008 will finally teach your kids to be patient. You were not born as a Santa Claus. You were born to face brutal challenges that you conquer.

I cannot afford to heat my entire house, I can only afford to heat one room. What is ironic, is that I am still alive. My greatest fear in life was to die from the cold. I am apparently surviving because I can.

Christmas is also about teaching about humility. The baby Jesus was born in a cold barn, because they were that broke.

What you could do if you only get paid after Christmas, is to ask each one of your kids to make a wish list of what they want, make the list on Christmas day. Put all the lists in a glass jar and seal the jar with a lid. When your child manifest the gifts that were wished, then that child gets to remove from the jar, the wish. Each wish is on a different piece of paper with their name on it and the date it was written.

Lady, I believe in miracles because I have witnessed the impossible on too many occasions. I have been in absolute despair in my life on too many occasions and yet, angels always showed up at my door steps out of the blue.

Angels do indeed exist and that is why we celebrate Christmas. To remember that when we wish upon a star, regardless of a deadline, the wish is always granted with patience.

Explain to your family why you are devastated that you cannot provide gifts for Christmas. You will be beyond surprise to hear what your children have to say about the matter.

You are victimized because you fear a future that has not existed yet. You are not allowed to create your future with the fear of your past.
Read my answer to your family so they know there are a lot of caring people out there who truly care for your welfare.

Do not make Comcast the bad guy here. The bad guy is the supervisor who needs to be denounced for his lazyness and his disrespectful behavior towards your husband.
The supervisor is a tyrant because he found a victim in your husband.

Look the other way, it is not your husband who is at fault here, it is the mismanagement of a single supervisor. I could get this supervisor fired with one phone call because Comcast is liable.

A crime has been committed and it is up to you to inspire your husband to do something about it. Comcast is in deep trouble. The supervisor knows this and he is bullying your husband because this supervisor is a bullie.

First of all, it may not have been his supervisor's fault. Since the payroll employee quit, his paperwork may have just fallen through the cracks.

I would sit down with the supervisor and ask exactly what happened and what he needs to do as soon as possible. Keep the pay stub, just in case you need it for proof later. If his supervisor doesn't give him the answers he needs, call someone higher up. Like all big companies, Comcast will have a Corporate Office or something similar. They are the center of what goes on, and can help him further. Have your husband call them and explain his situation. They'll be able to help him further.

To answer your question as far as "can they do that..." it all depends on company policy. If there is no policy saying that they reserve the right to retract vacation pay and they didn't post that no vacation pay would be available, then it is probably not right for them to withhold that pay. With the economy in the state that it is, it's very possible that they posted that no vacation premiums would be available. As I said before, your best bet is probably to contact the corporate office and find out more information regarding your situation. Best of luck.

The only thing I can suggest is to go to whoever is above him to get this straightened out ASAP. I'm sorry this has happened to you at Christmas.

go to the supervisors superior and complain. if that doesnt work then complain to the superiors superior.

It's unusual for a company to pay vacation pay ahead of time, usually you just get it at the end of the pay period that has the vacation time in it. This might have been their policy in the past, and maybe it has changed. But if he's finishing up his vacation, the pay should be in the current paycheck. It sounds like there is a rule (maybe new) that hours must be submitted for vacation as well as for work hours. Your husband should turn in his hours right away, labeled "vacation".
