My current job is not working out as I had hoped. It is too far away, my wages are too low, and i do not wish to be here any longer.
Upon discussing this with my boss she informed me that if she does not wish to break the contract, she can make me work.
Is that legal?

If you are an at-will employee, you can terminate the employment relationship at any time with or without cause, but of course there could be repercussions.
It sounds, however, as though you had an employment contract. Many times contracts will have provisions that allow you to break the contract by paying a fee. Otherwise, the employer could sue you for breach of contract. This could be quite expensive and the likelihood of such a suit would be very dependent on the type of work you do, the importance of the position to the company, the costs of filling that position and the difficulty in finding a replacement. Most companies shy away from employment contracts, so if you have one the company probably considers your position to be a key position and would likely try to enforce the contract.
Of course, this is all assuming you live in the United States. If you live outside the states, you will have to let us know so more appropriate information can be provided.

If you signed a contract, you are legally bound to work the amount of time stated in the contract: 30 days, 60 days, or whatever is actually stipulated in the contract.
Of course, you can quit and not return to work, but then you would be setting yourself up for a lawsuit, IF the employer wishes to pursue it. You could also get a bad reference, but I would just not put this job on your resume!
She cannot make you work any longer than the terms for which you signed! Just make sure you look over what you signed, if you think she will sue you. I don't want to speculate, but I really doubt she will sue, unless this is a very hard-to-fill job and she won't be able to find someone to take it or it is some kind of job where you are bound to trade secrets or some other kind of secure information.

Go read your work contract. Be advised that they can sue you for specific performance...so you may wish to contact a lawyer.
If the company paid recruiting expenses or moving expenses in hiring you, they can demand to be paid back (these usually require you to work there for at least a year). |
