Can I claim for constructive dismissal after taking voluntary redundancy as my employer left me with no option

I have been off work sick for 18 months and my employer is trying to sack me for gross misconduct which I am fighting however they have made this process very difficult for me and I have now been pushed into a corner which leaves me little option but to take the voluntary redundancy. I wondered if I could make a claim after accepting voluntary redundancy for constructive dismissal

It sounds as if your employer is trying to do the best for you.
I think you would be foolish to accept voluntary redundancy and then claim it wasn't.

Don't accept voluntary, you won't be able to claim for constructive DISMISSAL. The proof is in the word.
If your employer has tried to dismiss you for gross misconduct on what grounds did they state??
Gross misconduct normally results in instant dismissal after your employer has conducted a disciplinary process.
You do need to get some legal advice from acas or your union as you are under a contractual obligation to work for the company and as you haven't been to work for 18 months they may find that you are in breech of your contract.
Without knowing the full facts it would be impossible to advise you what to do but i personally would read all i could on the acas website and then ring them for some advice.

Yes you could, but you should keep a copy of every letter written and a record of every phone call regarding the case
