Can I collect unemployment ???

today august 27 i presented to my employer a resignation letter effective on september 23. The company did not allow me to stay till that date so they decided to let me go effective date today, almost a month before i was planning on leaving.
can i apply to get unemployment?

under MOST states unemployment guidelines gaurdianangel is INCORRECT as far as the notice part.

gaurdianangel is incorrect in EVERY state about having to be fired or laid-off, no state disqualifies based on quitting.
the standard is the loss of employment through no fault of your own.
quiting with cause is not your fault.
you can quit for numerous reasons and qualify for unemployment.

in MOST states what has happened to you is considered as the employer terminating you without cause and you will be able to draw benefits for the time of your notice and possibly longer.

you should file immediately !!!!!!

qualifying is based on numerous other criteria and you may not qualify due to those reasons but not do to the reason your question addresses.

I would try. The worst that can happen is that you get turned down. You resigned and gave almost a month notice and they told you to go now so its more of a layoff than a resignation.

You can submit a claim with U.I. on-line and see what happens. It's not considered a layoff as you initiated the separation not the company. There are a number of companies that do not have people work out their notices, they let them go the same day they give notice. Just be truthful on your application for benefits, that you gave resignation and the company released you rather than have you work out the notice.

A big factor here is, do you have another job to go to or were you quitting with no other job? If you quit with no other job then you will not be eligible for U.I. benefits. You can only get benefits if you are laid off, company closed or lost the job through no fault of your own. (Company relocation) If you quit a job then you are disqualified for benefits.

That's funny the exact same thing just happened to me. Do you work for that evil corporation known as Cablevision? I don't think you can file for unemployment, I think you're just another victim to the greed and human apathy displayed by the communications companies...oh wait that's me!!!

Unfortunately, you are not eligible to collect unemployment benefits when you resign from a position. It does not matter whether your employer honers your notice or not.

In order to collect unemployment compensation benefits you must be let go by your employer for a reason that is no fault of your own.

When you decide to terminate your employment on your own accord, you automatically do not qualify for unemployment compensation benefits.

However, everyone is entitled to apply for unemployment compensation benefits but the true fact is that you will be found not eligible to collect.

Sorry to be the bearer of bad news. It is best to find new employment before giving notice to your current employer.
