I was put on a PIP (Performance Improvement Plan) after 9 months in my position. I was given 3 months to improve other wise my employment would be terminated. In my position every month we are scored on 4 calls for quality. The first month my first 3 calls averaged to a 70 which is passing. My last call my supervisor failed me for the call which meant I did not pass for the month which gave me a written going into my second month. The second month same thing. Final written given for my third month. Same thing 3 call averaged 70 and final call she failed me. At the end of the 3rd month it clearly indicates your performance has to be met or you will be terminated. I failed the call which meant that I would be terminated at the end of the month or before. After speaking with my Supervisor she indicated that it was out of her hands and is now HRs decision. She indicated a decision would not be made until the 10th. On the 25th I asked her in light of my possible termination should I look for another job and she implied yes. I resigned on the 26 and unemployment informed me I have to have a hearing to decide if I had due cause. After being in a position for 9 months I assumed everything was fine. Now I am told I have 3 months or else I am being terminated. Where was my feedback on my performance in my 3rd and 6th month. I was employed for 1 year. Do I stand a good chance of collecting or what do you feel my chances will be in getting denied benefits. Additional Details I was in class from sept - January. Placed on the floor without a Supervisor for at least 3 months. My acting supervisor never gave me any side by sides or feedback about my quality of work. My supervisor returned for about a month then had a nother supervisor who have me no feedback then put me on a verbal after 1 coaching session after 6 months. Does that have no justification. Everyone is suppose to get 6 coaching every month to assist them in their weak areas I did not get get that. Does that not account for anything.

look for a job
go through the unemployment process but what you have stated is not cause. "cause" to quit includes (not limited to) issues such as discrimination, retaliation, significant change in pay or hours and employer relocating more then 50 miles.
progressive discipline, performance improvement plans, counseling and training sessions are not a requirement of law but are steps taken by employers to retain employees. the fact that any of these steps were taken shows the employer did what they could to keep you employed. it seems they did all they could and you just did not perform to their standards. |

Every state is different. Its not looking good for you though. You quit and you had many written warnings. I'm 90% sure you will be denied. It wouldn't hurt to try though. I would still be looking for a job though because your more than likely not going to get it. There is a chance that they may not show up to the hearing. |

Your question is really confusing. But the general rule is that if you quit rather than being terminated, that you aren't eligible for unemployment. It sounds like you were saying that your supervisor suggested that you look for another job, but didn't tell you for sure that you were being terminated. |

You resigned, therefore you probably won't qualify for unemployment. If you had stayed, you would have been fired for poor performance -- you would have had a better shot at unemployment, but even then it wasn't guaranteed.
All you can do is file, if denied, appeal. It's really out of your hands now. I would try really hard to find another job instead of depending upon unemployment!! |

Michr, this question for you sounds like they never did provide the additional training and follow up with the employee to retain them, would that make a difference or could that make a difference in the outcome. Sounds like they let 6 months go by before saying or initiating assistance. |
