Can I get fired after resigning?

I was given a promotion and after 3 months new I wasn't capable of adequately doing the job. I went to my supervisor, crying, and explained. It was agreed that I could go back to my old position, but I had to give 30-days notice in writing. I completed this period, kept a positive attitude and did the best I could. (I'm honest when I say, I know my work was below par, but that's why I asked to transfer back) I then went back to my old position, but was called into my old supervisors office one month later. She explained that I was being terminated for poor performance at my "promotion" job. Can they do this? What if I had just quit?, they would not have been able to fire me a month later. Im very frustrated.

depending on what state you work in, a employer can fire you for any reason. see if your company has a chain of command that you can try to appeal the decision.
did you save a dated copy of your letter of resignation?
you should go sign up for unemployment now. if your company tries to fight paying your unemployment your letter of resignation should help you to get the funds. unemployment is not from the government funds. it is from ur employer. they fired you without just cause so therefore you are entitled to the benefits.

They can legally, but it doesn't seem very reasonable.

That said, you'll at least be able to collect unemployment while you look for a new job.

The short answer is yes, in most cases, a company can terminate you at any time, for any reason because you are employed "at will." That being said, this appears to be some sort of "retroactive termination." If you weren't performing int he new job, you should have been terminated prior to being transferred to the old job. It was poorly handled, to say the least.

If you had quit, you would not be eligible to collect unemployment, so at least you can file for that while you look for work. Good luck.

Yes, it was a legal termination. My guess is that they really didn't need you back in your former position.

And crying to your supervisor was likely not wise either -- seems really unprofessional. It's one thing to have a discussion and admit you are in over your head, but to "cry" ... that was probably the deal breaker.

Just let it go -- go find another job that you're better suited for. Good luck.
