My friends boss acts very wierd. She is giving conflicting orders and may have a medical condition common to the aging. In order to prove this, it may be neccesary to record her daily activities and show how bizzare her actions have become. Is this legal in the state of Colorado? I know Colorado allows for recording conversations as long as one party is aware. If only those conversations involving the recording party and the boss are recorded, would this protect the recorder? Additional Details My friend works for a small family owned company. The boss has dimentia. She gives conflicting orders and yells and screams when people don't follow each order to her liking, even though the orders are conflicting. She doesn't want to video tape, but use a voice recorder to try to prove to other members of the family that the mother (owner) is losing it and needs medical attention. The family seems to be in denial. Her possition has been a revolving door due to this fact. She likes her job, but can't stand the situation as it currently is. I have advised her to find a new line of work ASAP and quit without notice. Since the family is in denial, they deserve to go through numerous employees as punishment for this abuse. Other employees are quitting because of this. However, she is a bleeding heart and wants to do something to help them out. So, is it legal for her to record, on audio tape, the bosses interactions with her? We are in Colorado which does allow recording if 1 party consent

yes it is legal to record a conversation with the knowledge of one party but........................................
that recording is for your use only and can not be used for anything other then your own reference and recollection.
it has no validity in court or any legal proceedings without validation.
the law does make it legal for someone to record another person without their knowledge but...................
was written to protect the one doing the recording from criminal prosecution.
the law does NOT protect the recorder from civil litigation if the recording is used for anything other then reference.
your friend needs to communicate her/his concerns first with the boss and then with the bosses supervisor or HR if the employer has an HR department/person. communication about the concern is how you resolve the issue not recording people. |

Its kind of rude to video tape someone and be like here watch this youre odd, why not just tell her about her behaviors it can be less insulting. But...If she is told before she has been recorded that she is going to be recorded and she AGREES, then its fine. But if she isnt told or is told but after she has been recorded some serious lawsuits and possible arrests could come from it. If asked and she agrees get that agreement in writing, if she changes her mind and its an oral agreement she could report that shes being recorded/stalked against her will. They would beleive her, unless you have a written agreement. |

All recorded evidence must be supported by an affidavit,other wise it is inadmissible in legal proceedings. |

It's unethical to spy on anyone, but that doesn't stop employers from spying on employees, so why shouldn't employees spy back on their employers. If you are careful enough not to get caught, I say go for it. |

It would probably be better if your friend contacted the HR dept at her company and discussed her concerns with them. It will be up to HR to investigate or decide if further action is needed.
Or she should discuss her concerns privately with the boss above her boss.
Granted, HR or the other boss - are not going to tell your friend anything. They may take action that she does not see or know about. But, if its a valid concern...she can and should discuss it with someone.
If it's not a valid concern....and it's just a personality conflict between her and her boss.....then she needs to keep her mouth shut.
Video taping her boss is not going to win her any friends. If she does that, she may as well plan on looking for another job. That's going to go over like a lead balloon. |
