Can I refuse to do a job at work because the equipment I have been provided is inappropriate ? to my health.?

I think I know the answer is definetly yea as we are all responsible for our own health and safety, I have had a serious back injury and can only use upright vacuum cleaners and we have none as they are all out of order! I am refusing to vacuum until I have been given the proper vacuum cleaner, whats your angle on this?

For those who state I am unable to do my job please read this, I have been with this employer 11 years, I have been . I was off last with this injury in 2005 , before that in 2002 when I first did it (dislocated my sacrum joint, part of my pelvis) and spent 2 weeks in hospital and 3 months off. I have had 2 risk assesments and stated to my employer the equipment I need, its not the weight of it although that helps! it must be upright as bending over from the waist strains my back and would anyones without an injury. I really dont think they can just sack me as they knew my history when i left for 2 months in 2006 and they still re-employed me knowing of my injury. They have always provided the proper equipment but at this moment in time cant be bothered for some reason to mend it as its broken.

Well seeing as they have been aware of your condition for a few years now I think its very unfair that they ask you to use a piece of equipment that could make your condition worse.

I disagree with one of the above comments who that they have provided you with equipment but you are physically unable to perform the job. Does that mean then that people who have carpel tunnel syndrome should not be given a wrist support pad or a ergonomic keyboard? Does it mean that those who have a tendency to neck strain should not be given risers for their computer screens to get it to the correct comfortable level? It's ridiculous to think that anyone who isn't 100% physically fit should be unemployable.

Employers MUST make the necessary adjustments for any employee who has a disability .... especially if they have been aware of it for years.

If you aren't registered disabled then do so straight away and if they try and sack you then take it to a tribunal.

Do you have any doctors note detailing your injury, and inability to work with the equipment you are refusing? I don't want to be the one to break this to you, but if your job requires heavy use of a vacuum, you don't exactly have a lot of bargaining power at your disposal. You will be lucky to keep your job.

There is a difference between an employer not giving you the proper safety equipment, and you being physically unable to perform the job.

I think if all sides are reasonable about it, you can work something out, but this is not a case of the employer failing to provide the right equipment, its a matter of you being unable to do your job.

Just be reasonable and polite and you'll be better off than being rude and demanding.

If your job involve you using a vacuum cleaner, and the company have given you a vacuum cleaner to use and you are unable to use it, then I'm sorry but that is down to you, if you can't use it, then I think the company can tell you to look for another job

I am thinking along the same lines as you.
I would also refuse to hoover, if the ones you can use safely and comfortably are out of order.

How are you supposed to use anything else, if it means your health is compromised, and you end up injuring yourself at work?!
Your employers wouldnt want this to happen!
They need to get the hoovers fixed if they want the floors clean!
