Can I sue if I am being laid off because of so call “budget cuts”? But the same week we where told they would have to cut our position they hired another person. And this person is still going to stay with her job.

The company can cut one department due to budget cuts and still hire staff in different departments. They can also lay off higer paid staff and hire on workers willing to take lower salaries. In any case, as you are laid off you can still collect unemployment benefits while you look for new work. If they fired you outright, you would have a harder time of it. In any case, YOU can't sue - you need a lawyer to sue, and they don't work for free. If you have the time and want to see what your chances are, set up a few appointments with any of those "no fee/contingency" law firms and see what they say. If they think you have a case, they will take it (for a percentage of your payment) and if not, they won't. |

You can try, but the problem is that if you do sue, win or loose, it might have a negative effect on your future career. Employers don't like to hire someone who has sued a previous employer. |

Sometimes companies lay off workers then hire new ones to replace them at a lower salary. You can sue but it won't do you any good and it would be a waste of your time. |
