I was recently terminated from my job as a computer repair technician. In the time I worked there I was unpaid for several hours I actually worked. One hour a day was supposed to be our unpaid lunch break but about 3 times a week I did not take the break because we were so busy that me leaving could have potentially hurt the store. Taking the full hour was also frowned upon by my ex-boss. She would typically say I was gone longer than the hour and would then gripe at me for my attendance. These unpaid wages have bothered me since day one but as this was my dream job and I did not want to put it in jeopardy. I just went with the flow. Now I have no loyalties to that company and want my money. What can I do?

The law mandates an employer offer breaks, which they did and there are no requirements for them to be used, which you chose not to do. Once you decided to violate standing procedure without advising the company, it became volunteer time and any recourse was waived at the end of each pay period.
Being terminated is bad enough, but being untrustworthy will haunt you forever and hurt honest, non-vengeful people every where. Would you even be considering something like this if your mother was looking over your shoulder?

You're out of luck. It's your word against theirs and the state always sides with the employer, NOT the employee. |

Did you have a time sheet or time card to annotate the hours you worked? If so, were they signed off by your boss as being accurate? If not, it becomes your word against hers and you are on the losing end, unless there are other employees willing to testify on your behalf. Not taking a lunch hour(break) was your decision and it could be argued that you were not forced to work during that period. A Wage and Labor Board could conduct a hearing on the matter, but once again, proof is needed to support your claim. Sorry. |
