I was working for my ex Employer for about a week. Before the week ended, i mentioned to the manager that I was dyslexic and because I can get figures wrong, i always double tripple, check things. I was then fired by the CEO, who was informed about my dyslexia, the following week.
I was told that I would be paid for two weeks.. but now the empoyers is making excuses not to pay me, by asking for my passport, even though i gave them all the details they needs before I was employed. I never got a contract, as they were apparently sorting it out.
I cannot get them to pay me, and feel uncomfortable sending them a scanned picture of my passport.
I want to now sue them for unfair dismissal, as I was not informed why i was fired and no training as promised was provded to me. The employer knew what I was capable of, and I worked very hard, proactive, whilst working for him. There was no reason given to me for being fired.
The employer himself has fired five other PA's before employing and firing me. Workers that do work there have said that it is a regular occurence for him to do this. They even told me that they joked about how long I would last.
Do I have any rights?

this is a unlucky situation, you have a right to be paid for the time you worked, but you don't have a good case for wrongful termination, even in a union job they can fire you in the "probation period" usually of 90 days. if you had proof, in writing or someone who heard them say it was because of dyslexia then you would have a discrimination case, but as you have no proof then you have no case (unfortunately). with such a short term of employment they could say it was a "personality conflict" and it wouldn't be wrongful termination.
Don't bother working with the company to get paid, the longer they string you along the less likely you will ever get your money. they don't need your passport, they are trying stall you long enough, so that you let too much time pass, and they wont have to pay you!
you need to contact your local Department of Labor A.S.A.P. they will enforce that they must pay you. be honest about what hours you worked, then tell them that you were promised two weeks pay. |

Nope, no rights. They pretty much can cut you loose at any time unless you were in a union. As for a discrimination lawsuit, you could possible pursue one, but it could go either way for you. They can either just pay you the money to make you go away or they could resist, meet up in court where you would most likely lose. |

Without knowing what state/province/country you were working in it's hard to give you good direction. IN general, you should consider contacting an attorney who specializes in employment law where you were working. Also, you can contact the government agency that oversees employment law where you were working.
The relevant facts you want to have in hand are the job description, any communication (e-mail, fax, letters, even voice mail if possible) that pertain to this. |
