Can I sue my new employer?
Find answers to your legal question.

Can I sue my new employer?

I work in a petrol station which has just been taken over by Murco. The new proprietors are from India.
I worked yesterday from 2 till 10pm & am shifted to work today 10-6pm. At 7am this morning they telephoned me 4 times in succession, got through to the answerphone then hung up without leaving a message (I shoved the phone under a pillow). They do this regularly.
Maybe I should answer the phone the first time it rings, but I know that they will be asking me to come in to work immediately instead of later, even though I had given them the choice of altering my hours the day before so I wouldn't be working back-to-back.
If these telephone calls continue, where they don't leave messages but hang up, will I be in the position to sue them for harrassment & maybe make a few quid out of it?

ScarySquirl - that was really funny because as I was reading this I thought this person was from the UK, as we refer to Petrol stations as Gas stations - and I've never heard of Murco. We also refer to answerphones as voice mail, and I believe that "quid" is slang for Pound - a currency in the UK - not the US!

As far as the answer: If you want to find out what your true legal rights are and want to do the research yourself, go to www.direct.gov.uk and search out "employment law".

old know all
You could, but don't expect to keep your job as well.

ANF
Write a letter to them asking that they do not use your home phone for this purpose, apart from some set periods of time. They could be disturbing other household members not only you. Also try unplugging the phone when you are in bed etc. It will not ring then. At their end they will hear a ringing phone but no answer. Plug it in only when you are ready to accept calls

You can quit the job. You are annoyed but you have no damages.

Why he has to be american? Anyway, No, you don't really have terms to sue but only a local worker's barrister can tell you that. Most cities have free advice services, like a citizens advocate. It is obvious they value you as an employee or they wouldn't be calling you. Let them know that you would like them to leave a message if they call your home and you will get back to them at your earliest convenience and if you don't call, that means you aren't home. They do not have to know if you are home or not. There is apparently miscommunication somewhere. Also let them know which number you prefer them to call and what times it is ok to call.

The Bricklayer
answer the phone.

record any conversation

listen to what they have to say,if there is a problem then go to citizens advice

No. Your employer can contact you if he needs to. Unless it's at completely unreasonable hours and unless you haven't told them not to call you, there is no law against picking up the phone.

Champagne 7 SUSPENDED AGAIN
Haha - you'll be laughed out of the court.

Lets not sue everyone we meet ok?

You must be a prat for giving them the number in the first place. You could have given them your mobile and keep that switched off when you are in bed

ScarySquirrel
Bloody hell, why does everyone (I assume you're a yank) take this stance of SUE SUE SUE just to make a quick bit of money.

Quit your job if you don't like it.
