Can My Employer Force Me To Move To Third Shift?

Is there a labor law for california that disallows an employer to make an employee change to a different shift even though the employer knows that it will create a hardship for the employee reguarding child care? Additional Details This isn't because they need me too work on that shift. They said that if I don't move to thired, they will take away my recent promotion because I am not being flexable (a term of the promotion I was not aware of). They know that I cannot and are using it to use against me.

The employer has every legal right to require you to switch shifts, and if you refuse it will cost you your job (it would be seen as you quitting). Try talking to your employer about it, tote your good work history and all you have done for the company but if they insist you switch there is nothing you can do. |

Companies are allowed to staff to meet needs of the business and change your schedule as they see fit. Its unfortunate however, it is not illegal.
Companies these days are less employee friendly.......especially now that the economy is busted. |

No, to both questions. They can't "force" you, since you can quit if you find the disadvantages of your job outweigh the advantages. There is no law that requires them to accomodate your lifestyle (unless a handicap such as being unable to walk, unless it keeps you from being able to do the job).
They can require you to work that shift or fire you if you can't meet their needs.
You can talk to your boss to see if you can work with them to compromise, or you can quit and look for another job. |

If they don't "need" you to work on that shift, then why are they asking you to do it? I think you may be misunderstanding their requirements. Working the third shift generally means more pay. Did you possibly overlook the other requirements, while looking forward to the pay increase?
California Labor Law allows an employer to assign staff as they see fit, to maintain a profitable business.
Look at the job description for the job to which you were promoted. If the requirement is there that you must work variable shifts, then you didn't really qualify for the promotion, because you are unwilling to abide by the terms of the job description. You can't have it both ways.
I don't believe they are "using it against you". If there was any doubt that you could perform your new duties, they wouldn't have promoted you.
Everyone has home issues that have to be taken care of 24/7. How you resolve these to accommodate your work schedule are entirely your responsiblity, not your employer's. Nor should you mention that as a reason for your not being able to be there. Ask for clarification on your job duties and make your decisions accordingly. Leave the whining out of it, and show your professionalism.
If you cannot work within their requirements, then you must look for another job.

Yes, your employer can tell you that you HAVE to move to third shift. No, you don't HAVE to do it - you could quit.
Sometimes this is a subtle way for an employer to get rid of you. They don't want to fire you because then you could make a claim for unemployment. They are just making your life so difficult that you choose to quit. |
