Can a boss refuse to approve holiday...?

...because there is no-one else in the company that has the skills to cover that persons job?

first holiday dates aren't until the end of april. and this employee has been moaned at previously for not taking the full holiday dates from last year mainly because it was never convenient to the company. five days have been carried over into this year.

In most cases it is not possible to 'carry over' holidays from one year to another. An employer must however allow holidays not necessarily on the date requested but the law states that employees acccrue approx 2.5 holidays per month of employment. If your employer refuses a holiday he must provide you alternate dates in which you may take holiday time. Maybe time for you to move on and find a better job and a more professional boss ...then they would have to pay you all your holiday time!

Yes, an employer can do that. You are entitled to your holidays but the employer is entitled to say when they can be taken. Get your request in very early so you beat any others to the post.

If you mean he is refusing to let you take your holiday AT ALL, that is illegal.

Yes, they are well within the law to do that.
Company policies vary, the amount of notice given will effect the boss's decision, the more notice given the better.

I don't really understand the last bits that you've added on. You state that "first holiday dates aren't until the end of April" (which I take to mean that you would be permitted to take leave at the end of April) but then you say that "this employee will never be allowed a holiday" - actually, they are allowed a holiday, it's just that it has to be in April and not when you're asking for it.

To be honest, I don't understand what your employer's problem is. In every company I've ever worked, there's never been anyone that can do my job but I still go on holiday. It just means that all the work piles up on my desk until I get back. That's why many employers have rules that you may not take off more than two weeks in one go. Trust me, absolutely no-one's job is so important that the whole company will collapse if their work isn't done for two weeks. I used to be PA to a CEO and we could manage a whole month without him.

Basically, your employer must allow you take all your contractual holidays. If this is not possible, then you must take the statutory number of holidays, but you and them can come to an agreement where they can pay you out for the difference between contractual and statutory holidays. They are under no obligation to allow you to carry over days from one annual leave year to the next, unless your contract states otherwise (it's not unusual for a contract to say that you can carry over up to five days).

Provided that these conditions are met, then they have a right to dictate EXACTLY when you can take holidays. Think about anyone who works in the education sector (not just teachers, but school receptionists or anything like that) - they get school holidays off, but then there is absolutely no allowance for them to take off even one day more.

technically, they can refuse. But it is also ur right to take holidays as you are entitled to it.
But the earlier notice you give, the more ahead of time ur boss can plan out replacement procedures. So if u tell him/her a week before, it wont do u any good. I told my boss my holiday plans 5 weeks before.

If you are in the USA, your boss cannot refuse you a holiday, but he is under no obligation to pay you. That is the answer.

Of course, it's their company, and it's why they have to approve the leave request, otherwise people could just do what they want.
