Can a former employer hold your last 2 checks and change the rate of pay?

I worked for a gas station for a month. I had a "no call no show" (Obviously i didn't care for the job) Although it's grounds for immediate termination they took it as "willful termination" i.e. I quit. What i want to know is if they can change the rate of pay from $8.00 an hour back to the state minimum on the money/hours they haven't yet paid me for? I live in Ohio and at the very least i would like to know who i can contact either to find out if it's legal or to make a complaint against the company.

I am sure they are not allowed to do that. Just because you did not show up to work, they cannot lower your wage to minimum wage.

I am sorry but I do not know who to contact for that one.

If you worked at an agreed rate of $8.00/ hour they can't change the rate of pay for those hours after you already worked them. Contact the department of labor and Industries in your state to ask about your rights and file a complaint.

They can however record on your file that you quit. When you don't show up, they can assume that its because you quit which means you won't be eligible for unemployment benefits.

Get in touch with the Labor Relations Board at your State Employment Office and ask them what to do. The position you applied for should have a wage scale according to the State Statutes and they will have to pay according to that scale. You are a very poor employee to have quit this soon and in this manner but they should at least pay what they agreed to when you hired on.

I have heard of many companies doing this...Companies lower the rate of pay to minimum wage when an employee leaves, perfectly legal to do.

They can not hold your check, they must send it to you the following pay period.

Unless you signed a contract of some kind (not usual for a gas station job) they cannot legally hold your paychecks past the regular paydate you would normally have had...they also cannot arbitrarily change your pay rate for hours already worked.
Should talking to them yourself get you no where...call or go by and speak to someone (I'd recommend a visit) at your local Social Security Office...they are the ones to file grievances with employers...
