Can a male employer search a female employee?
Find answers to your legal question.

Can a male employer search a female employee?

I have been informed that my line manager may start random searches at the end of work. Is that legal even with another female present?

No. It would have to be by a female for a body search. He could do a bag search though.

He cant touch you or do a body search. Hell I dont think even a female can do that. Im sure in your contract they can check your purse or have you pull out your pockets of your pants, but thats about it.

If they think you have something on your body and they are positive of it. They call the police and risk a lawsuit if they are wrong. Security can most likely detain you, with cause, until the police arrive. But they better be right. But dont let anybody touch you, male or female.

No employer has the right to search you.

Basically no its a form of assault. It's not even that simple for a police officer.

You would be entitled to use reasnable force to defend yourself.

I would join a union and tell a union official of your bosses intentions they will deal with it.

No a woman has to be present. Don't take any orders. Sorry I meant a woman has to do the search.

I wouldthink that highly unlikely to happen female wouldsearch female thank you

No, that is not permissable at all. If you suspect theft you may use surveillance equipment, request police involvement or request that employees consent to a search - but you cannot demand it. Gender doesn't even come into it!
What are you going to do if someone refuses?

i don't think so even the police have female officers to search other women. the female present might be able to but you can still refuse but then they would have to get the police to search you or who ever.

no they cant.

I think a female has to do females and males to males. If he is a guy he can let a female do it and him supervise.

No one can search you unless they are the police and then they have to have a good reason to do so. Hubby is a security guard.

No, if you think someone is stealing have them arrested the police will search them.
An employee can search lockers, desk, purses, lunch boxes or other things if the employee agrees but without a search warrent nothing more.

bigmatlem
Random searches for what reason? They had better not even attempt it. They have the right to search your property on the property such as locker or coat as long as it isn't on you and other such, but your person? NO WAY!

What kind of an outfit is this? You are an employee aren't you? Not a prisoner? Man that really gets my goat.

Talk about abuse. If this starts you must call immediately and file a complaint with the Equal Employment Opportunity Commission in your area. Then let them investigate. If they insist on a search then you need to call the police to be present at this as depending on where you live this may be illegal.

Freekin commies!
