My manager told me that I'm going to be the first one to get fired if the company starts to do layoff's? Can they do that and can I sued them for that? Additional Details no I am not a crappy employee! I get to work on time I do volunteer for overtime and I also do it when ask to stay late, I also come in on the weekends. I get along with all my superiors except my manager!

as the others have answered;
YES they can tell you
and
NO you can't sue them and WIN...............
hopefully they aren't going to have to lay anyone off but at least you know now to be looking just in case. |

You can't sue them - in fact, by telling you that they were being very considerate and encouraging you to start looking for another job as soon as possible. Companies can let employees go whenever they want to without even giving any notice at all. |

Sue them for WHAT? Hurting your feelings?
No, he did nothing illegal. In fact, he might have done you a favor to let you know so you can be looking around for a new job.
Good luck. |

You know what really pisses me off? That people think they can sue just because their feelings were hurt.
It's CONSIDERATE to let you know, so you can start looking now rather than wait on your @ss for another job to fall out of the sky.
Or maybe you're just a crappy worker.. in which case, you better look, and look hard. |

Why does everyone think they can sue anybody for anything? Do you think working for someone is a democracy? Of course they can tell you that. It might be based on the fact that you have the lowest senority but, more likely, it is based on your attitude as shown in this question. If you want to be considered a valuable employee then work to make yourself an asset that your employer considers valuable. |

Yes they can but they will have to have a real good explanation of why are they firing you. Unless that you live in Florida |

It depends I'm not really sure on all the legal stuff, but I have a feeling they could get in trouble for that. |
