YES, as long as what they say is truthful or they believe it to be truthful.

there are no laws that prevent truthful (even if it is bad) information from being released.
employers are in violation if they knowingly say good things about an employee that are false just the same as if they knowingly say bad things that are not true.

many employers as a matter of POLICY don't release information but it has nothing to do with the law.

as far as: can they stop you from getting a job? NO they can not.....
only you control that.
if you have attendance issues; or poor performance; or quit with no notice; or violate policies and procedures that is your fault and those are the things that keep you from getting a job not the former employer releasing information about those problems.

Former employers can say legally say anything as long as it's true. Many companies have a policy of only verifying employment dates, maybe job title and salary. But there is no law that mandates this.

It was always my understanding that they could only verify the dates. But when my husband got a background check for his new job, they sent a copy and it said they guy had said he was " a mediocre employee"

I have always heard they cannot say anything bad about you BUT really there is no way to tell. You can hire a company to do a series of calls like potential employers and they report back to you but they charge you for these services. Most employers will tell you they just verify that they worked at the company. I usually always refer potential employers to HR because there is a reason that I am no longer with the company (usually the management or lack of it). May be a good route to go if you have one of those previous bosses that are egotistical bullies that couldn't get laid in a brothel with 1000 bucks duck taped to his chest. Good Luck.

If the company has a HR department, then no legally they are only supposed to verify actual employment and dates and salary. BUT some employers will ask if you are eligble for rehire, for which they can get a NO and that sends red flags.
