it is legal but not very smart.......................
how can there be retaliation if the complaint has not been made already?
retaliation is protected against under whistle blower protections not by the EEOC.
if there is an actual claim filed the complainant is not to be discussing it while the investigation is ongoing.

making false claims of investigations that are not actually underway or baseless threats of filing complaints with the intent to intimidate would be grounds for disciplinary action.
GOSSIP is generally grounds for discipline up to termination. |

Yes you can tell the other employees anything you want and then be escorted out the door by security after you are fired. Why tell anybody anything? Just report the offense to the EEOC. Be sure to have your notes handy and dates, times etc. |
