Can an employee terminated during a probationary period file for unemployment?

Yes, I have actually done it myself. You can file, then the EDD will call you and ask why you got fired, you then state and they get a report from your employer. If your employer is a huge pain, then they can try and fight it but it is a huge hassle and I have never heard of a company doing that. Even though you were on probation they still separated you from your job and have to pay unemployment. So with that long answer go ahead and file you should not have any problems.

Depends on your state law. The state laws govern unemployment benefits. In Illinois, for example, a person who is terminated can collect benefits UNLESS the termination 1. was for violating a significant rule/policy, 2. the employee had been warned that if they violate that rule/policy they will be terminated, and 3. the employee willfully and knowingly violates the rule/policy. There is no exemption for being on or off probation. If the employee has not logged sufficient hours for the unemployment benefit to come out of this employer's fees, then the IDES will look backward to the previous employer.

Bottom line is that you do no know if you can get unemployment benefits unless you try.

Short answer, no. That is unless you also have documentation that you corrected/improved the things you were suppose to correct/improve upon during the probationary period. You would most likely have to go to an unemployment hearing type thing to prove your case but with good documentation and if you have witnesses to speak on your behalf you could still get it.

As long you weren't terminated for gross misconduct, excessive lateness or absence, violence (you get the picture.) You can likely receive the benefit. All previous jobs including the present are taken into consideration for your claim since you must have worked a certain number of weeks to be eligible. Since you do not indicate what State you are in I am unable to advise you what your exact State laws are.

2 months ago i took a leave for Christmas and the day my leave started my boss sent me termination latter i was on probation and he didn't even clear my commissions he promised for. but he gave me all my monthly wadges bt my commission account was quite high he changed my % either .he dismiss me without any VALID REASON
