Can an employer cut your wages just becuase you are on light duty?

I have a friend that works at a local food lion and she was injured on the job. She is now on light duty and they have cut her wages back. can they do this?

Interesting how those who said it was illegal and received a thumbs down when they are not altogether wrong. Your friend must have been out on workers compensation. Unfortunately, this no longer means the employer has to keep your position open if they can prove a financial hardship and the position must be filled. However, if your friend was eligible for FMLA (Family Medical Leave Act) he/she would have had to return to a same or like position for the VERY SAME rate of pay. If your friend was employed a minimum of 1 year and worked a total of 1,250 hours minium and his/her place of employment has at least 50 employees in the last calender year they would have had to cover him/her under this Act. If your friend was not eligible unfortunately the employer was able to change the position to accomodate him/her at the rate of pay for that particular job.

In the U.S., unless state law differs, you can be reassigned duties and paid for the new duties. Your wages cannot go below minimum wage.

It is not against Federal Law.

Yes, an employer can scale a wage to the position. If your friend is doing a different position wit ha different pay scale, it is OK.

Why not? I would assume so -if she's not doing as much work as she was, it's not worth it for the business to be paying her for work she isn't doing.

Yes, providing she does not fall below minimum wage it is quite legal to do so, maybe not ethical but legal

Redvelvet is not neccessarily correct. The original question only says that the friend was injured on the job, not that she took any medical leave or now has a major medical condition or disability. You can't assume that she does.

Nope, illegal. They are required to make reasonable accomodations at the SAME rate of pay.

No. Illegal. If you are in the United States tell your friend to contact her state department of labor. I would also consider speaking to an employment lawyer. Now. Let me advise you if she or he is an hourly employee they can cut their hours as part of the light duty accomodation. Wages could not be cut back though if they are still working the same hours regardless if they are on light duty.

No employer is ever allowed to reduce wages for whatever reason without agreement from the employee

What your friend needs to be careful of is if she continues to allow the new working conditions/(pay cutt) it can be seen as agreement
