I suppose they could but there are laws that say your previous employer can only comment on your performance and not on anything else. If you did something illegal and were prosecuted then it could show on your background check but they are not supposed to say anything negative about previous employees, otherwise nobody would ever get hired anywhere else.

Only if you tell, or if they learn through the rumor mill. Because of prior lawsuits, your prior company if contacted by your current company is only suppose to provide dates of your service, and they can give a nod on salary range if asked. They can also answer if they would hire you again or not, but they can not go into specifics. Meaning the new company could ask, "Is ..... eligible for reemployment at your company". Then of course the old company could either say yes or no, but legally they can not say no and then go into that they fired you and why. If they do, you could turn around and suit the previous company for deformation and causing you to lose a job with the new company.

However, if the new company reads between the lines from the no- they will not hire you back, then there is nothing you can do.

Not legally. You have privacy rights pertaining to employment that a previous employer would be criminally liable for violating. However, many investigators call places up on the phone, tell some kind of story, and are given all kinds of details they are not supposed to get. You do have to answer the questions on your job application truthfully, under penalty of getting fired for lying, and "reason for leaving" is a standard information block in every employment history. They will call the number you give for the supervisor you had, and will ask what they want to know. It is up to that supervisor to tell the truth, or lie, or protect your privacy after you are long gone.

Yes, but legally, it would be the fact that if you were eligble to be rehired and a personal character refernce. Realistically, many people say it how it "was". If this new company doesn't hire you and states a reason based on your former employer that seems beyond normal, which most will never screw up and say, you may have legal recourse towards your former employer
