Look at your contract. If it says you have an obligation to work extra hours when needed then yes. If it doesnt, or you have no contract then no.

Under the Employment Rights Act (and amendments) an employer can only impose overtime if it is contractual, that is stated within the contract of a employment as a specific term.

If an employer seeks to impose overtime outside of this provision, it will be unfair in relation to the contract and could be unlawful in relation the health and safety legislation.

did you sign a contract that had overtime included ?

Phil McCracken
No they can't, UNLESS you signed a paper opting out of the European Working TIme Directive, or if your job is exempt from the directive, or is reasonably a "work to finish" job.

Jobs included in the directive, you cannot be made to work more than your contracted hours, or more than 40 hours per week, or made to have less than a 10 hour rest between shifts, or 11 hours when changing from days to nights/noghts to days. Opting out is your choice.

Some jobs are not covered in the directive - food production, security (military and civilian) and health care workers cannot be covered by the Directive.

It depends on the nature of your job. Example would be if your a doctor or other medical practitioner who needs to work extra time to save a certain life. Or just an ordinary worker who need to make extra emergency work that could critically affect human lives and property of that matter. Other matters not related would be voluntary and of your own discretion.

No, he can't insist. Yes, he can sack you anytime he likes because he feels like it. If you have worked there for less than 2 years he doesn't even have to tell you why.

Welcome to the real world of post Thatcher employment protection.

No...if i'ts not you're contracted hours (i.e. the ones you agreed on when you first starting working) then you are under no duty to work.
If he keeps on pressuring you i'd talk to your union representative because i'ts against the law, particularly to threaten with disciplinary action. Ask your manager who the union representative is or how to get in touch with them. He'll probably **** himself + offer you a payrise!
Hope that helps + good luck!

only if it contractual

as far as a know - if the overtime is hours outside your contracted hours, you do not have do do it. If he's being a pain about it, see the hr department or trade union (if applicable)Request a copy of your contract and double check this

No, overtime is exactly what it says on the tin. Its work "over" your normal time and thus is completely voluntary.

If you have a contract though i would check that first, some contracts state that you must do a certain amount of overtime.

As a general rules though, if you cant possibley do overtime then politely refuse.

If you can do overtime but dont want to... then do the overtime anyway. Not only will you get more money but you'll be in your boss' good books the next time you either refuse/ask for days off/ or ask for a raise.

nope overtime is voluntary

Overtime is a choice, not a contractual demand on behalf of your boss.

In some instances, bosses sometimes request you do overtime IF you have not dont your weekly hours you were contracted to do so.

If you have done your weeks hours that is stated in the contract, he cannot demand you do overtime.
