After completing 15 minutes unpaid/unscheduled overtime my friend inquired to her boss about this 'overtime'. He told her that apparently he was within his right to request any employee to stay for 20 minutes extra after their shift (regardless of whether they had been late starting - which she had not). He told her this 'rule' was apparently on the internet but I/she doesn't know where to begin looking, so I wondered if any of you had heard of this 'rule', where I could find any info on it or if it is made up completely...
Oh and she is on a wage, not a salary

no any overtime has to be paid if she is on a wage.if he dose not pay you then go to a citizens advise and they will give you help and advice |

If it isnt in her contract then legally he can't do anything about her leaving when her work time is up. |

That would depend on the contract or agreement between the employer and the employee. Neither party can violate that contract. |

Well if they have a written contract, then they should have it written on it.
Making he doing unpaid work is actually classed as theft from the emloyee.
If there is an union in her workplace then get her to contact them regarding this. |

my work place did the same thing for 15 Min's but dropped it for a reason,can't remember why.it sounds like you work for a big company my advice find another job,if it's a big comany they will alway's want there pound of flesh from you and nobody outside the company will help and your work life will be made hell,so leave or put up with it |

What do you mean "she is on a wage not a salary"?
If she has been working for this employer for 8 weeks or more she must, by law, have been provided with a 'statement of particulars' which will detail her working hours, pay etc.
If this 20 minutes falls outside her stated work hours/bands, then it can only be classed as overtime. Nobody is required to work 1 minute of overtime. It is entirely voluntary and the pay should be agreed in advance with the employer.
If her employer is suggesting that employers can demand staff work for an extra 20 minutes by law - he is talking out of his backside.
If he is referring to company policy - she should ask him to point out where is states this in her terms & conditions.
Nobody has to work for nothing! |

I've never heard of this one and I suspect he is making it up completely. Here's where to check: www.dol.gov. You want the" wage order" that applies to her industry (manufacturing, hospitality, food service, etc.) Then look under "overtime pay." Kind of tedious reading the government lingo but it will get the info you need.

Actually there are several determining factors in this case. One, which state does she reside in. Most states are "right to work" states which tend to favor an employer over the employee 90% of the time. In those states, an employer is not required to offer vacation time, sick leave, or even lunch breaks, though most do or they wouldn't have any employees.
Two, the company's policy for which she works should state whether or not this a "legal" company move. There is "fine print" in most company policies which allow for certain liberties an employer may take, including keeping employees after their scheduled shift if needed.
Her best bet is to check with the local employment office and ask what the rules are for that area. My first guess is that the employer can get away with a 20 minute rule, but not 30.
