My boyfriend works as a mechanic for a car dealership. He works flag time which is like full commission. His employer has started a new program because customer service shops have fell. The new program says that if they make below an average of a 92% on shops the employer can take up to $500 our of their pay. Is this legal?

My boyfriend has not had to pay. However some of his coworkers have. And they are wanting everyone to get together and file a lawsuit. I just wanted to check the law before he pursued anything.

What everyone else is saying is correct - he must be paid for time worked and every state has their own employment laws that oversee this. Go to www.usa.gov and do some research. If he is working on commission, and that commission is based on a rating, and his employer rolled out a new program that everyone knew about, and possibly signed off on, then it may be legal. |

As long as they are making at least minimum wage after the deductions, and the terms of pay and deductions are clearly stated up front, it's legal. |

The only way an employer can with hold pay is with authorization from the employee or the employee was overpaid on the last paycheck.
An employer has to pay all wages earned within a pay period.
A call to the state dept. of labor should get them their money and the boss fined. |

Gem is right. Every state has different laws. You would have to research your particular state's law, or consult an attorney or contact the labor board. |
