I was under the impression that there were some legal issues with an employer paying an employee to drive from their home to their place of employment. The state that I am wondering about is Ohio. I haven't found any supporting information on either side.

you probably won't find anything in Ohio law other then the fact that employees must be paid for all work hours. the definition of what is work hours is set by the US department of Labor with clarification from the courts. you can find the definition of work hours and what travel time is considered work hours here:

an employer can pay more then the law mandates not less so with that consideration,
yes they can but they don't have to unless.................
if the employee is traveling out of their normal work city to another work site for the day then the employer must pay for their travel time. also anytime the job "requires" travel to a central location and then on to a work site that time between the central location and work site must be paid time.
if the employee is traveling on a bus train or flying then generally the employer does not have to pay for that time. |

Yes, they can, of course, but as stated elsewhere, no company is required to do so.
Your company can pay you for whatever reason they want, but this amount is fully taxable income, with no eligible deductions. |

Yes, you can, but there are issues with this. If they receive a break from you and you pay that money to them, the government may come back and audit the employees records and backcharge them for that amount. If the employee doesn't keep records, or writes that he was paid to come to work (as he should be keeping a coil book with his miles) the government can decide to deduct his income cheque or even collect interest on the money already paid out.
The employer only gets breaks on individuals driving during work time. |
