Can an employer refuse you a reference if dismissed for gross misconduct on POTENTIAL LOSS of company monies?

Cheques turned up 4 days late and the company is claiming potential loss? no evidence has been provided and they are refusing a reference even though this was not part of the persons role nor was it in their job description. Can they do this?

What if they have refused to comment at all? they dont even want to confirm dates?

an employer can refuse to give you a reference for any reason, or no reason at all

Sure. Companies are under no obligation at all to give a reference. Besides, if the company blames you for losing them money, chances are that you don't want their reference anyway.

I have worked forcompanies that give out no references.

As far as I know, companies are not REQUIRED to give references. If I was the person being dismissed, I certainly wouldn't want the employer saying anything negative about me so I wouldn't push the issue.

they can refuse to give you a reference and refuse to give employment dates over the phone

A company is not required to give you any reference what so ever, and are usually only required to verify employment, depending on the state law.

Legally, a former employer does NOT have to give a reference...and these days many do not. They simply confirm employment dates.

No U.S. company is compelled to provide a reference regardless of the disposition of the work history. This includes those states with "right to work" laws which are aimed at preventing employers from controlling whether or not an employee is a union member.

U.S. companies are increasingly shying away from issuing references and, especially, recommendations as they can generate legal liability. This, following a series of suits successfully brought against old employers (the recommenders) by the hiring company when the employee turns out to be a dud.

In England, it looks like an employee is entitled to be provided by his or her employer ONLY with a written statement giving particulars of the reasons for the employee’s dismissal whether or not any notice of termination is given prior to termination. You may want to look at the Employment Rights Act of 1996 for further details.

Although it might not be your fault that the checks went missing, it sounds like you might not want them to be a reference anyway and any company can refuse to be a reference.

yes they can and who says an employer is required to give you one at all? the only thing they are required to do is verify dates of employment.
