Can an employer take your tips and give them to someone else?
Find answers to your legal question.

Can an employer take your tips and give them to someone else?

My daughter works in a place that has one tip jar. At the end of each shift, the jar is counted out and divided equally between the employees. Last night, the supervisor decided that two girls worked harder than the rest and gave them the entire tip jar to split between them.

My daughter is saving for college and her paycheck go right in the bank. She depends on her tips for "spending money". I've searched the L&I website and I can't find any laws regarding tips.

Sorry, I should have specified that I'm talking about Washington State. I know the L&I laws are State specific.

what state?
generally the tips go to the employee if you are in a state that allows for a lower wage for tipped employees.
in some states it is allowed for tips to be pooled and split but generally when that is the case they must be split the same all the time it can not become selective such as what you have described.
as noted without knowing what state a definitive answer can not be given.

edit your question
OR
e-mail me
OR
call your local office of your states department of labor, wage and hour division.

EDIT:
some states have excellent web-sites and many more are a nightmare to try and find info on. if you don't already know the answer and know what law to look for you may never find what you are looking for on many state's sites.

The best thing to do is not say anything if she ever has hopes of going to college.
Maybe the supervisor was being unfair,
But in all reality if your daughter would like to keep her job she should not say anything over $5.00.

There's probably nothing your daughter can do.

Personally, I hate tip jars and the equal split concept. There's nothing fair about it.

Legal but kind of a strange thing to do.

An employer cannot just give her tip 2 two other girls like that! The tip was suppose 2 b divided equally!
I wish I could help u find the law that prohibits that, but I'm not a Lawyer!
