After being employed by a specific company that isn't going to mentioned, we'll just call it DG and I'll let you come up with something. Well, after being employed by DG and working for 9 straight days, i get a call from the District Manager on my day off at 8 am telling me I was terminated. The reason for termination was taken from my performance on a survey that was to be given before employment, but was given to me the night before of the incident. Now, i had taken a survey like this when i filled out my application, and since then they instituted this new one. As far as I know, i am the only one given this survey and the only one being penalized for it. Please give me some advise.

1. what do you mean by a "survey"?
2. what state are you in?
3. under contract or "at-will"?
answers that include "right-to-work" have nothing to do with your situation (right-to-work has to do with non-union members being allowed to work in union shops and relationships with unions in non-union shops)
"at-will" implies that no contract is involved and the employee may quit or the employer may fire at any time for any reason or no reason
(except legally protected reasons such as discrimination or retaliation)

your facts aren't enough to give a valid answer. what are the labor laws in your state? are you in a right-to-work state or are you in an at-will employment state?
also, what is it that you do? is your position a technical position that requires some specific technical skills? or your job is just a run-of-the-mill kind of one?
you have to take all of this into account, also since you've only been working for 9 days, your legal options are not that much, since the company can terminate you at anytime during the period of probation.
you should approach your company's human resource dept and ask what appeals can you take and get a written report on the cause of your termination.
if you were singled out by the company, you may sue for reinstatement and its corresponding damages. |

I dont really understand your situation, you wrote it kind of confusing, so I am trying to tell you what I know about company surveys.
First of all, in the future, NEVER participate in them. You cannot trust your employer EVER.
Second, check if you live in a right-to-work state, which makes it very difficult for them to fire you.
However, even if you live in a right-to-work state, companies usually have the right to terminate you during your probation phase, which can be as long as one year, depending on the position.
Also, there are two types of surveys, or candidate exams. One are aptitude tests, where they test your ability in grammar and language skills, which is sometimes required for example when writing emails to customers.
The other survey would be by your manager, who evaluates your performance without your knowledge during the first few days or months at work. If there was an incident, then that might be taken into account. I work in healthcare, was on probation for three months, and screwed up one night, not royally, but severe enough for them to fire me. I was reprimanded, but not fired and the whole thing disappeared from my record a year later. So I doubt that because of one incident they would fire you.
Call Human Resources and ask for your appeal options in regards to you being fired. If you dont get a good answer, talk to a labor law attorney. But, honestly, would you really want to go back to a company that fired you? I certainly wouldnt. If you give me more information I can help you out a lot better. |
