It is not the law to record a hearing but it is not illegal.
As long as you are aware of the fact and agree then there should be no problem.
Personally if I was subject to a disciplinary hearing then I would be the one recording it to ensure that a. I had all details and b. that it was carried out properly.

It can be done, but only with your permission!
This happened to me a few years ago during a number of disciplinary meetings. My company decided to do it after I insisted on taking verbatim notes in the hearings and they did it to speed the process up. My barrister said that it was unusual but was more accurate than written notes.
Make sure that you insist on a copy of the tape recording before you leave though, some note takers have been known to not be accurate. |

I do not think the law has anything to say about it one way or another.
You should say that you will only agree to a taped interview proving you are supplied with an un-edited copy of the tape (dead easy, they only have to use 2 machines at same time and give you the tape from one).
When you think about it, this avoids any ambiguity about was and was not said and is as much for your protection as theirs. |

I don't think it is legal practise...normally you can take someone in with you..a person that you choose. I would ask ACAS as they are there to advise people in situations in the work place. |

If a recording is made, it should be agreed to by everyone in the room.
I'm not sure whether you're an employee wanting to record the hearing, or whether you're the employer.
If the employer wants to record it, the person chairing the hearing should ask at the start whether everyone is agreement.
If you're planning to record it, and you're the employee, you should ask beforehand (in writing if possible) whether the employer would agree to this.
Whoever records the session should make sure that they have a machine that will produce two copies at the meeting (NOT that you say you'll take it away and send it on later). That person should meet any costs involved.
One copy should be with the employer, and the other with the employee.
Remember that hearings are difficult all round. Don't cause antogonism by turning up at the meeting and just 'announcing' that you're going to record it.
It can be far better to have a companion with you; someone who you trust to give an honest view of the meeting at a tribunal if it goes that far. Honest isn't the same as just someone who will stick up for you!
