Can employers deduct service costs from commission checks?

Can employers deduct service costs from commission checks?

In an Illinois car dealership, commission checks are given each month on service sales. The employer keeps deducting the costs of customers' rental cars from the check. Is this a legal deduction? Every thing we have read, says no, but does anyone else have any answers? This employer does not even tell the employee that they are taking these costs out, and so far has taken about $400. The employee is doing nothing wrong. This is a car dealership, and they give out rental cars to customers, while they are working on the car. Please help, and tell us what can be done.

It will depend on your employment contract.

You are independent contractor in most of the case. It is really up to your agreement with your company.

If you are an employee (with W-2), then it is illegal.
