Can employers really do this?

My husband has been accused of threatening a fellow team mate with killing him if he was to find out about a certain something. My husband has only asked the guy if he knew who ''dobbed'' on his friend. Now his workplace are telling him they have a witness to this (but wont tell him who or what they saw) and they had him in for a meeting today, only to get him in for another meeting tomorrow, where he feels they will sack him. Can they sack him for his words against theirs, when there is no proof of this happening? He is permanent part-time and has been with this large company for 4 years. I feel like he has worked his butt off there for virtually nothing. We will lose our house and all. He is not the type of person who would just go around threatening people for someone elses problem. I believe him 100%. I just need to know, according to Australia's workplace laws, can they do this or not? i hope someone can help!

He was sacked today. They had no hard evidence like statements and no full explanation.

If they have witnesses then that is all the proof they need.
He would be sacked for gross misconduct.

If your husband's employers do not have proof that he made any threats, there's not much they can do to him...it really depends on what the witnesses say - he must be entitled to have a representative with him at the meeting? (From his union perhaps?) Either way, he should be prepared to question any witnesses and produce any of his own (is there anyone who can back up your husband's story?) He really just has to appear and answer the allegations against him calmly - it's up to them to prove he's done wrong remember and they'll need hard proof. Good Luck.

The company will conduct an investigation and get name of witness and their statement (if any). If there is proof that your husband did in fact threaten a fellow employee then your husband will be terminated immediately.

When conducting an investigate of this nature it is crucial that there is evidence and not hear say. If that is what they are basing it on then the person must be creditable and that the stories need to match.
