Can i be disciplined at work for taking a day off sick in December?

The company i work for are trying to give me a verbal/written warning for having a sick day in the christmas period, even though i followed there procedures for sick days. can they do this and where can i get professional advice on the matter

It depends what their policy on managing absence is. Some organisations do deal with short-term absence issues under their disciplinary procedure - so if the number of days you're having off sick has reached an unacceptable level and/or is causing a negative impact on their business, then they can take action. You need to have a look at their policies and procedures to ensure they are following them. Also, what's you're history in terms of sickness - is this the only day you've had off, or have there been others in the past as well?

The department of employment have counselors that can answer your question.

How many days were you off work? Does your company require for you to bring a doctor note in order to get paid?

I worked for this company and you were not paid for the first day that you were out, but if you were out more than two days you got paid for all days??? Their reasoning was if you were out more than a day they could get someone to cover your position from another department!!! So, everybody knew that when someone called in sick, they would be out at least two days--crazy company policy!

are you off sick a lot? If you'd been off sick in a less busy time would they do this and has anyone else been disciplined?

or maybe Acas. You can not help being unwell so maybe if they had told you that you were being sick too often it would make more sense?

I can see from your profile that its likely you are British. As it stands, if this was an isolated incident then they probably should give you 'counselling' as in ' we have noticed you were off sick during a busy time, is there a reason with this? ' blahdi blah.

But I really am not an expert. As I've said, if you are too ill to work then you are too ill to work. If it was the first time in a long while and they wouldn't usually discipline people for an isolated incident then I would follow their greivance procedure for appealing. If you aren't in a union now might be the time to join one...
