hi,
Im extremely frustrataed as my employer held an investigation into gross misconduct on my part.. (for a matter which i did not do and which i repeatedly explained).... I was so insulted and upset that i gave my notice to quit. Howwver i have just recieved a letter stating that i am being dismissed!... can i be dismisssed despite that fact that i quit? thanks id appreciate any info!... im in ireland if that means anything in relation to the law Additional Details sorry, i would jsut like to ask also, does this dimissal show up as i was actually fired? i hate the fact this this might affect nay other job i want in the future! it was only part time as im in college but i dont appareciate the idea that this will affect me in the future.Also, does the fact that i quit not mena that i was no longer in their employment? thats why i did it but now it seeems in vein... thanks!

Yes you can be dismissed even though you handed in your notice.
Gross misconduct is normally an immediate sacking.
Even though you had handed in your notice, until it is accepted and you work your notice you are still working there officially
Course it will show that you have been fired - what do you think dismissal is>?? |

yes I don't see why an employer couldn't dismiss you, after all you have given your notice to quit. so you are still an employee, and employer is within their rights to dismiss any employee.
it does sound very odd though. either the employer is being petty and vindictive or there are other issues going on. it could be that the employer is trying to converrt your resignation into a dismissal for political reasons (make them look 'toughger', satisy other parties (eg unions or senior management) that 'something' has been done.
however in practice what difference does it make.. I'd argue very little. however if the employer is ignoring your resignation letter, and insisting that your dismissed then possibly you have grounds for constructive dismissal.
in personal terms, no one likes being dismissed, it alwasy hurts, especially if you have done nothing wrong. But I'd suggest that one way of reconciling whats happened is to rationalise that that employer
doesn't have a clue, their opinion is worhtless so move on, nad find somewhere else where you ARE appreciated for your worth |

no he cant but he can let you go and pay you your notice if he dosnt want you in the building, alternativly if he invites you into the office for a disciplinary you are aloud time to get a witness together,i recomend a solicitor as your witness and then he will back track as he wont want the hassel,citizens advice will advise you of the law, |

What do you mean "show up as being fired"? There is no national registry listing why you left jobs. A potential employer could find out how you left your old job in two ways. 1.) They ask you and 2.) They call your employer. If they call your employer, the question is what answer will your employer give? Most large companies don't give any references anymore because they are afraid for being sued for slander.
Ask HR what your companies policies regarding references are. Try to get the direct number of someone at the company who is friendly and will give you a reference.
Anyway, if you were fired, you may get unemployment. You can't collect unemployment if you quit. |
