i was hired by a union trucking company in vacaville and was three months into a six month probation period when i was fired without warning and explanation. the union rep referred me to human resources because they can not help until my probation is past. HR gave me 3 reasons why the district manager fired me and all 3 of them were invalid. (I'm 100% positive i could prove them invalid, given testemony and witness of my co-worker.) but when HR called the district manager and asked if he would rehire me upon proving his reasons invalid, he said no because he didn't like my "attitude towards the company" -- which makes no sense considering it took me a year to get the job and i quit another to do so. is that legal? if i get a lawyer and fight it, could i win? what might that cost?

If you were hired "at will", meaning no "contract" you can be fired for "no reason".
Since you mention a probationary period, if you were within that time, then yes - you can be fired for no reason.
Unless you were fired for discrimination or retaliation, then you have no legal recourse. |

I initially wrote that I'd recommend that you get in touch with the Dept of labor. If you have a valid case they will assist you in pursuing it :) However, when I reread your question, I saw where you were within your probationary period. They are not required to have any reason to let you go during a probationary period... sorry :( |

Depends on the laws in your state, but generally it's legal for a company to fire someone within the probationary period without cause. |

they have to give you a reason... but if they didnt like your attitude they can fire you. but god news you can get unemployement which is great because they have to pay a part of that!!! |
