my day off, phone rings at 7 am i was asleep until then, very grumpy stating as i pick up the phone i shouldn't have answered the m______ f_____ phone. now my supervisor writes me up for insubordination. Legal?

Absolutely legal, and appropriate!
The only reason you made the statement you did is that you knew who was on the other end of the phone. Even if you didn't, you owe the rest of the human race more respect.
Feel fortunate you didn't get your a$$ fired. You would have if I was the one on the other end of the phone. |

whether on or off the clock you are a still an employee and talking to a supervisor like that can get you fired |

I'd challenge that-take it up with whoever's over him, or HR. |

What that is the most stupidest thing I ever heard in my entire HR professional career. (well not really but its up there)
I would write on the write a detailed reason as to why. If they are going to play it that way, then file a grievance for him calling you on your day off.
I would talk to HR about this, ridiculous. |

Definitely go to management and your HR dept about this.. Explain that you certainly would never address anyone at your job in this manner - that you had no idea who was calling you so early at home on your day off..etc. |
