My back started hurting me out of no where about 3 weeks ago and it just keeps getting worst. I just got a letter in today saying taht if i fail to go to work i will be terminated. I have not been able to work the last 5 days out of the 6 she gave me. I have been going to dr.'s about my back and i have told my boss that i am hurt nd i called her every time i could not make it. Is it legal for her tofire me?

It is against the law to terminate you while you are off ill .you can ,however,be made to see a firms medic and have a medical examination,if you are found to be not fit to do the job ,you can then get medical separation,which will involve a settlement payment.There is also the health and safety at work act,which is your greatest friend if you know it.It is illegal to report for work knowing yourself to be unfit,it is illegal for your boss to permit you to be on works premises knowing you to be unfit,both offences carry fines as punishments and would severely affect any claims either way. |

unless you were injured at work yes they can fire you. It is called employment at will, you can quit anytime, they can fire you anytime. Being sick is no excuse. Sorry
You can file for unemployment. Maybe disability as well. |
