i dislocated my neck after a head bump otj i was placed on light duty told that i could stay on ld for 6 mths and was struck by a car while doing lite duty otj my hire date was 3/2my fired date was 9/22 reason for term was illness and or injury there clause is i was not past my prob but i was never the less the reason stated on file is what i stated above so is this precidious against the 3 workers comp claimes i have against them state is md my avg wk is 789.00 im ready to sue my perm is i have epilesy narcolepsy and mem loss and loss of use in my back and neck and i cant stay up long enough to work can anyone help me with my ? and tell me how this is calculated

sorry for your trouble, however most people don't realize there is no protection while on WC, unless you are part of a union, it is very unfair but in no way illegal |

A company has an obligation to keep you on light duty or to TRY to find work for you that you can do. If your injury/illness prevents you from working at all they are only obligated to the terms of your workers comp claim. Beyond that if you still cannot work and they don't have another position that you are qualified for they may let you go. If you've had multiple claims in a short amount of time they can claim you were careless and caused your own injury risking the health and safety of yourself and others. This is very tricky ground. You really need to consult with an attorney, not a bunch of random internet posters. |

You should contact an attorney in MD that specializes in employment law. Take all of the relevant facts to them. If there are monetary damages to be claimed, they will work on contingency and be paid upon payment of the judgment. |
