i was laid off. the employer told me to come back to work on jan 2nd. they keep calling me each day and putting off me coming back 1-2 days out. they are doing this to other people. they have already told the dept of labor that we are working and our employment benefits have stopped. what is this called? what can we do?

If you are laid off they do not have to pay unemployment. Your employer is the one that has to pay this benefit on your behalf. They are stalling because they do not have the money to put out.
You need to go into the employment office so they can verify that you are telling the truth. Your employer can be in serious trouble with the state by blocking you from receiving your benefits.
You can also call the labor department in your area, and find out how you follow through on this action.
I hope that you are looking for another job because I would not want to work for a company like that.
Most cities have a One Stop Center aka Career Center. They have all types of job bulletins from all over the US. There is no charge for their services; workshops, computer classes, copy machines you can use,fax service, counselors to help you find a new job, etc. |

I would call if fraud, I would call the dept of labor and make them aware of what is going on. Either they are screwing all of you over or they are making an effor to get you back to work. Best wishes hope you get back to work soon. |

Sounds like they are using a loop hole. You could call Human Resources; Better Business Bureau. You might want to call a few other employees and then call a lawyer. If your being denied what you were guaranteed as part of your employment, there are counter measures for you. |

I don't think they can legally do this. I would call the Dept. Of Labor and report what is happening. It is not fair that you are not getting unemployment benefits during this time when you are not working. I think they are doing this to avoid having to pay the benefits in the meantime. I don't think they can do it but you should just check with the Dept. of Labor just to make sure. |
