Can my employer backdate my dismissal?

I was suspended on full pay by my employer, and on 26/08/08 a disciplinary hearing was held in my absence at which I was dismissed. My employer has written to me stating the dismissal will be effective from 12/08/08, which is two weeks before the actual disciplinary date. By doing this my employer has not paid me for this period. Is this right?

When were you suspended, not the date of the disciplinary hearing? You said you were suspended with full pay so I am a little confused.

Did you do actual work during that time? No. So likely the employer's actions are legal.

He can but he's likely to run into legal problems, you should be careful in asking him to do this because if he gets found out he could be in deep do do. As well as your self. Remember do the honest thing.

hello. i had the same problem a couple of years ago. best thing to do is contact your closest citizens advice bureau who will make an appointment with you and get you the exact money that your owed. i got 6 weeks wages in total.
