My manager above me have disagreed over a number of issues, I have now settled the issues on his side but, a letter has been drawn up, a nasty letter which will only be given to me in six weeks time if i have not toed the line so to speak? is this legal to hold a staff member over a barrel?

It sounds like you've been put on some sort of work improvement plan. However, a work improvement plan should state the deficiencies and what must be done to meet standard. The manager should meet with the employee periodically to review the employee's improvement. At the end of the probationary period, a decision must be made as to whether or not the employee made the necessary improvements or not. If not, then the employee can be terminated.
I think your manager got mad at you and wrote up a nasty letter to get even with you. You need to talk to HR about if you have been put on a WIP. Specific deficiencies in performance and what you must do to correct them must be stated in writing. In other words, force your manager to comply with company policy. If you're deficient in some areas, then he is supposed to help you remedy them. As a manager, he's supposed to rise above personal feelings and help you to be a better employee. |

I suspect that you have worked there for 6 months and that they are keeping options open for dismissing you before you get to 12 months employment.
At 12 months you have employment rights and could take them to tribunal.
It is not normal to use the term probation at this point. It is usual to issue a warning letter. |

What country are you in? If you are in the US, then yes they can legally put you on probation, or actually could just fire you without any probation. |

Go to your human resources department and ask to make copies for your own files of any paperwork that you signed.
If he drew up a nasty letter and had you sign it... you are entitled to get a copy of that.
If the letter is not in your personnel file then have H.R. investigate the issue. Employee files are very, very confidential and not a single piece of paperwork from Dr. notes to write ups are ever allowed to be kept anywhere else but in your personnel file at human resources.
If you have seen the letter, read the letter and the issue is acknowledged then that letter better be in your file otherwise your manager is using some very unfair labor practices... and should have his head examined by the Human Resources Dept. |
