Can my old boss get her job (now mine) back?

Two weeks ago, my boss decided to put in her notice and move out of state as an adventure to find another job. I was offered and accepted her position. She did not show up for work the last two week so I have fully assumed her position. Today she told me she felt overwhelmed by that decision and she regrets putting in her notice. She told her boss that her plans to move "fell through". Today was her last day, and she came in for maybe an hour total to pick up some things. Does anyone know what my rights are if my employer was to demote me back to my previous position and re award my boss her job? Is that legal? Not that she would do that but just in case - Im curious.

Nothing illegal. Your boss can do anything he pleases in this situation. The only illegality here would be you have a stupid boss. I certainly wouldn't hire her back. Who is to say she won't do it again? However, I do not think you have anything to worry about. She picked up her belongings and was in the office an hour. If they wanted her back they would have called her into the office while the opportunity was there. |

If you work for a good corporation, they will not take your position away from you. If she wants to come back, they will relocate her to another store ( if there is a position open).
One thing, you are new at this position; make sure you follow company policies and procedures. Do not give them a reason to demote you! This would be the only way, she could get her position back at your store. |

It's legal for them to give her the job back if she wants it and they want to give it to her, and to demote you back to your old job. |
