There is nothing illegal, or even company related on it. I used it for my personal files. After being walked out, I asked for it back, and they are holding it for a few days to check it out. Its been a week now, and I want it back...

If it was connected to an office computer, they have to rightto make sure you are not stealing company info. |

Hmmm. If you had it attached to HIS computer, he might have a legal claim. However, if it's in your possession, he has no authority to compel you to turn it over to him. If he wants it, tell him to get a court order.
Putting a personal hard drive on a company computer is NOT a good idea. |

If it's in his possession what's to stop him? Otherwise tell him to sue you for access to it. |

I am assuming that you were at work when the search happened, if that is the case then your former employer has every right to search your HD and any other personal property such as backpacks and purses. Once you leave their property your employers have no right to search at all. |

If your employer knows that you use your personal computer/HD for work (work from home/road, whatever) then the intellectual property rights and company documents are what they are trying to protect. It is likely that if you do not allow them to scan your HD for their corporate information that they will compel you by law if necessary, especially if they are concerned that you will take proprietary information to a competitor. |
